The Apprenticeship Training and Employment Contract

The apprenticeships are regulated by legislation and there is a training contract between the apprentice, State Transit and the Department of Education and Training.  This training contract is concurrent with the temporary employment contract between the apprentice and State Transit.

The training contract requires the apprentice to attend and complete all the training requirements of the vocation. Apprentices are required to maintain an individual Apprentice On The Job Training Diary to record work place learning and undertake training at State Transit work sites and other sites as and when required to do so.

The training contract requires State Transit to provide all on the job training and release the apprentice to attend off the job training.
All apprentices must pass a probation period of three months.  The probation period can be extended by up to a further 3 months.  This is in accordance with the Apprenticeship and Traineeship Act.

There is no guarantee of permanent employment at the end of the apprenticeship. Vacant permanent positions are filled using merit selection principles and successful applicants would be required to demonstrate competency in all aspects of the work requirements.
Other key conditions applicable to apprentices include:

A 38 hour working week, Monday to Friday.  Starting time each day is between 6 am and 7 am.  Apprentices should note permanently appointed tradespersons are required to work shift work including weekends.

  • Compliance with State Transit’s policies, procedures and code of conduct.
  • Compliance with the National Code of Good Practice for Australian Apprenticeships.
  • Compliance with the workplace and conduct standards set by TAFE and other non-STA work sites involved in the provision of training.
  • Comply with the New South Wales Public Sector core values of cultural diversity, equitable and ethical practices and a safe and fair workplace.
  • Comply with the conditions set out in the Award and/or Enterprise Agreement applicable to apprentices in State Transit.
  • Apprentices are classified as a Transport Safety Worker under the Passenger Transport (Drug and Alcohol Testing) Regulation 2004 (NSW) (the Regulation).
  • Under the Regulation, it is an offence for a Transport Safety Worker to carry out work, or attend for work with the prescribed concentration of blood alcohol (presently 0.02 grammes or more of alcohol in 210 litres of breath or 100 millilitres of blood). It is also an offence under the Regulation for a Transport Safety Worker to carry out work, or report for work, while under the influence of any drug.
  • State Transit conducts random drug and alcohol testing of Transport Safety Workers. Alcohol and drug testing of Transport Safety Workers may also be carried out following a safety related incident or where there are reasonable grounds to believe a Transport Safety Worker may be affected by drugs or have alcohol in their blood.
